On Friday the Massachusetts Supreme Judicial Court ruled that inmates at jails in the Commonwealth should released due to the coronavirus pandemic.
Video or teleconference hearings will be held to consider individual detainee’s request for release, the justices said.
For an inmate not to be released, prosecutors would need to prove that they pose an “unreasonable” danger to the community or a flight risk.
The only inmates who would be able to request a “rebuttable presumption of release,” are those who are not sentenced, being held on bail and aren’t facing certain serious offenses.
