A New York City Correction Officer was arrested Wednesday for attempted assault and harassment of an inmate.
The incident happened on May 6, 2024, at around 3:20 p.m. at the Bellevue Hospital Prison Ward at 462 1st Ave in New York City.
Rol Garcia, 54, a Correction Officer with the New York City Department of Corrections since 2005 was assigned to the Bellevue Hospital Prison Ward when Ramon Rivera, a person in custody struck Garcia in the leg with his foot and smacked Garcia across the face.
Rivera was pulled away from Garcia and restrained by other staff as well as other inmates who assisted staff. But while Rivera was being restrained, Garcia approached Rivera, pulled back her right foot, and kicked at Rivera, intending to cause Rivera physical injury and to harass him.
Garcia has pleaded guilty, and as part of a plea agreement, she must complete 10 days of community service, attend all court appearances, and not be arrested for the next six months. If Garcia successfully fulfills those obligations, the Manhattan District Attorney’s Office will ask that the court allow Garcia to withdraw her guilty plea to Attempted Assault in the Third Degree and she will be sentenced to time served for the Harassment offense.
