Javier Silva in January was indicted by a grand jury in Worcester for two counts of rape and indecent A&B on a person with intellectual disability. On Monday Silva who is being held in ICE detention at the Plymouth County House of Correction, appeared before Worcester County Superior Court Judge William J. Ritter for arraignment on the above charges. A plea of not guilty was entered on all charges and Judge Ritter set bail at $200,000.00 Surety, $20,000.00 Cash. Judge Ritter also ordered Silva have no Contact with the Commonwealth witnesses.

Thomas M. Kinne in 2009 was indicted by a grand jury in Worcester for B&E building daytime for felony, larceny from building and receive stolen property. in June of 2010 Kinne pleaded guilty to the above charges and was sentenced for receive stolen property to 2 1/2 years House of Correction, for larceny from building was sentenced to 1 1/2 years House of Correction on and after and for B&E building daytime for felony he was sentenced to 5 years probation on and after. in August of 2010, Kinne filed a motion to revise and revoke seeking to vacate two consecutive sentences to the Worcester House of Correction and to substitute in their place a sentence of imprisonment to state prison. In September the motion to revise and revoke was allowed by the court and Kinne was sentenced to 2-4 years at Cedar Junction. Since Kinne has been released from prison he has multiple times violated the terms of his probation. On Monday Judge Janet Kenton-Walker found Kinne to be in violation of his probation and he has been committed to Worcester County House of Correction for six months
